1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the TruNutra website, online store, customer accounts, communications, content, product information, subscriptions, products, and related services operated under the TruNutra name (“TruNutra,” “we,” “us,” or “our”) (collectively, the “Services”).
By visiting our website, creating an account, placing an order, enrolling in a subscription, submitting information, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, and any other policies or terms referenced in these Terms or presented to you at the time of purchase.
If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility and Customer Accounts
You must be at least the age of majority in your state, province, or other place of residence to use the Services or make a purchase. If you permit a minor dependent to use the Services, you are responsible for that use to the extent permitted by applicable law.
You agree to provide accurate, current, and complete information when creating an account, placing an order, enrolling in a subscription, or communicating with us. You are responsible for keeping your account information and login credentials confidential and for all activity occurring through your account.
You must notify us promptly if you believe your account has been accessed or used without authorization. We are not responsible for losses resulting from your failure to protect your account credentials, except where responsibility cannot be excluded under applicable law.
3. TruNutra Services
TruNutra provides an online store through which customers may learn about and purchase dietary supplements, wellness products, and related offerings. We may also provide educational materials, product recommendations, promotional communications, customer support, subscriptions, loyalty benefits, or other features.
We may add, modify, suspend, restrict, replace, or discontinue any part of the Services, product catalog, promotion, or feature at any time, subject to applicable law and any specific written agreement we have with you.
Nothing displayed on the website guarantees that a particular product, ingredient, price, promotion, or service will remain available.
4. Health, Wellness, and Dietary Supplement Information
The information provided through the Services, including product descriptions, articles, emails, educational materials, customer reviews, suggested uses, and other content, is provided for general informational and educational purposes only.
TruNutra does not provide medical advice, diagnosis, treatment, or individualized healthcare services. Information available through the Services is not intended to replace advice from a physician, pharmacist, registered dietitian, or other qualified healthcare professional.
Always consult an appropriate qualified healthcare professional before beginning a dietary supplement or changing your health or wellness routine, particularly if you:
- Are pregnant, nursing, or trying to become pregnant;
- Are under medical supervision;
- Have an existing or suspected medical condition;
- Take prescription medications, over-the-counter medications, or other supplements;
- Have allergies or sensitivities;
- Are preparing for surgery; or
- Have questions about whether a product is appropriate for you.
Do not disregard professional medical advice or delay seeking it because of information provided through the Services. If you believe you are experiencing a medical emergency or adverse reaction, stop using the applicable product and contact a qualified healthcare professional or emergency service promptly.
Statements regarding dietary supplements have not been evaluated by the United States Food and Drug Administration. TruNutra products are not intended to diagnose, treat, cure, or prevent any disease.
5. Individual Responsibility and Results
Responses to dietary supplements and wellness products vary from person to person. We do not guarantee any particular health, wellness, physical, emotional, performance, or lifestyle result from using a TruNutra product.
Product effectiveness may be affected by individual health, diet, medications, lifestyle, consistency of use, genetics, environmental factors, and other circumstances outside our control.
By using the Services or purchasing a product, you acknowledge that you are responsible for evaluating whether a product is appropriate for your circumstances, following the product label and usage instructions, and obtaining professional guidance when appropriate.
6. Product Information and Availability
We make reasonable efforts to present product names, ingredients, quantities, images, packaging, descriptions, suggested uses, warnings, pricing, and availability accurately. However, we do not warrant that all product information is complete, current, or error-free.
Product colors, packaging, labels, capsule appearance, containers, and other visual details may differ from what appears on your screen because of device settings, manufacturing updates, packaging changes, ingredient sourcing, or other operational reasons. Product images may be illustrative and may not reflect every variation of the product delivered.
Product formulations, ingredient sources, labels, serving sizes, packaging, and availability may change without notice. You should review the physical product label, ingredient list, allergen information, directions, and warnings before using a product. If information on the physical label differs from information displayed online, follow the physical label and contact us with any questions.
We reserve the right to limit product quantities, discontinue products, restrict sales to particular persons or geographic regions, and decline orders where permitted by law.
7. Orders and Acceptance
Your submission of an order is an offer to purchase the products identified in the order. An automated order confirmation acknowledges that we received your order but does not necessarily constitute acceptance of that order.
We may accept, decline, cancel, or limit an order for legitimate business, fraud-prevention, inventory, pricing, legal, safety, or operational reasons. This may include orders that:
- Contain inaccurate billing, shipping, or payment information;
- Appear to be fraudulent, unauthorized, or intended for unlawful resale;
- Exceed available inventory or stated quantity limits;
- Contain an obvious pricing, promotional, or product-information error;
- Cannot legally or safely be shipped to the requested destination; or
- Otherwise violate these Terms.
If we cancel an order after payment has been processed, we will issue a refund for the canceled portion to the original payment method, subject to payment-processor timing and applicable law.
Products are sold for personal and household use unless we expressly authorize another use in writing. You may not purchase products for unauthorized resale, redistribution, export, or other commercial purposes.
8. Pricing, Taxes, and Payment
Prices are displayed in U.S. dollars unless otherwise stated. Product prices may change without notice. Prices may not include sales tax, shipping, handling, customs duties, import charges, or other government-imposed fees.
You agree to provide current, complete, and accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize TruNutra and its payment processors to charge that payment method for:
- The products included in your order;
- Applicable taxes;
- Shipping and handling charges;
- Recurring subscription charges, when applicable; and
- Other fees disclosed to you before the purchase is completed.
We may correct pricing or calculation errors even after an order is submitted. If correcting an error materially increases the amount you would be charged, we may cancel the affected order or contact you for approval before proceeding.
Promotional codes, discounts, credits, and special offers may be subject to additional conditions. Unless otherwise stated, they have no cash value, may not be combined, may be limited to one use per customer or household, and may be modified or withdrawn where permitted by law.
9. Subscriptions and Recurring Purchases
If TruNutra offers subscription or recurring-purchase options, the applicable price, delivery frequency, renewal terms, minimum commitment, discount, and cancellation method will be disclosed at checkout or in the applicable offer.
By enrolling in a subscription, you authorize TruNutra and its payment processors to charge your selected payment method automatically at the frequency disclosed to you until the subscription is canceled.
Subscription prices, discounts, product availability, shipping charges, and applicable taxes may change as permitted by law. When legally required, we will provide advance notice of material changes.
You may cancel a subscription using the cancellation method provided in your account, subscription-management portal, or applicable offer, or by contacting us at support@trunutra.com. Cancellation prevents future recurring charges when completed before the applicable processing deadline. It does not automatically cancel, refund, or recall an order that has already been processed or shipped.
If a payment cannot be completed, we may retry the payment, request updated payment information, pause the subscription, or cancel it.
10. Shipping and Delivery
Shipping and delivery dates are estimates and are not guaranteed. Orders may be delayed by inventory availability, carrier operations, weather, natural events, customs processing, incorrect addresses, high order volume, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect, incomplete, or undeliverable address may be your responsibility to the extent permitted by law.
Title to and risk of loss for purchased products pass as determined by applicable law and the shipping terms presented at checkout. Nothing in these Terms limits rights that cannot legally be waived.
International customers are responsible for determining whether a product may legally be imported into or used within their destination country. Customs duties, import taxes, brokerage charges, and similar fees are the customer’s responsibility unless expressly stated otherwise.
11. Returns, Refunds, and Damaged Orders
Returns, refunds, exchanges, damaged products, incorrect products, and non-returnable items are governed by our Refund Policy, which is incorporated into these Terms by reference.
You must follow the return-authorization and documentation requirements stated in the Refund Policy. Sending a product back without first completing the required return process does not guarantee that the return will be accepted or refunded.
Please inspect your order promptly after delivery and contact us as soon as reasonably possible if it is damaged, defective, incomplete, or incorrect.
Refunds do not limit any non-waivable rights or remedies available under applicable consumer-protection law.
12. Electronic Communications and Marketing
When you use the Services, place an order, create an account, or contact us electronically, you consent to receive transactional communications from us electronically, including order confirmations, shipping notices, account notices, receipts, policy updates, and customer-service messages.
If you separately opt in to receive promotional emails or text messages, we may send marketing communications in accordance with your consent and applicable law. You may unsubscribe from promotional emails by using the unsubscribe link included in the message.
Text messaging is also governed by our Mobile Terms of Service. Consent to receive promotional text messages is not a condition of purchasing a product.
13. Reviews, Feedback, and User Content
You may be permitted to submit reviews, comments, photographs, questions, testimonials, feedback, or other materials through the Services (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant TruNutra a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, format, adapt, publish, display, distribute, and otherwise use that User Content in connection with operating, improving, marketing, and promoting TruNutra and the Services, subject to our Privacy Policy and applicable law.
You represent that:
- You own or have permission to submit the User Content;
- The User Content reflects your honest experience or opinion;
- The User Content does not infringe another person’s rights;
- The User Content is not unlawful, deceptive, defamatory, obscene, threatening, or harmful; and
- You have disclosed any material relationship, incentive, or compensation connected with the User Content when required by law.
We may moderate, reject, edit, restrict, or remove User Content where permitted by law, but we are not obligated to publish or retain any submission.
Customer reviews and testimonials describe individual experiences. They are not guarantees that another customer will receive the same or similar results.
14. Prohibited Uses
You may not use the Services to:
- Violate any applicable law, regulation, court order, or legal right;
- Engage in fraud, deception, impersonation, or misrepresentation;
- Purchase products using stolen, unauthorized, or fraudulent payment information;
- Infringe intellectual property, privacy, publicity, or other rights;
- Harass, threaten, abuse, exploit, defame, or harm another person;
- Collect, track, or misuse another person’s personal information without authorization;
- Transmit spam, unauthorized advertising, or unsolicited communications;
- Upload viruses, malware, malicious code, or other harmful material;
- Attempt to gain unauthorized access to an account, system, database, or network;
- Scrape, crawl, data-mine, copy, or extract content through automated means without our written permission;
- Interfere with the security, stability, performance, or proper operation of the Services;
- Reverse engineer, circumvent, disable, or bypass security or access controls;
- Use the Services or products for an unlawful, unsafe, misleading, or unauthorized purpose; or
- Assist another person in doing any of the foregoing.
We may suspend or terminate access, cancel orders, or take other appropriate action when we reasonably believe a prohibited use has occurred.
15. Intellectual Property
The Services and their contents—including the TruNutra name and logos, product names, trademarks, trade dress, text, photographs, graphics, videos, product descriptions, educational materials, website design, software, page layouts, and other content—are owned by TruNutra or its licensors and are protected by intellectual-property laws.
Subject to these Terms, TruNutra grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful personal and household purposes.
Without our prior written permission, you may not copy, reproduce, modify, republish, distribute, sell, license, create derivative works from, commercially exploit, or otherwise use any protected portion of the Services except as expressly permitted by law.
No provision of these Terms transfers ownership of any TruNutra intellectual property to you.
16. Third-Party Services and Links
The Services may rely on or link to third-party platforms, payment processors, shipping carriers, subscription providers, analytics services, advertising networks, review platforms, social networks, and external websites.
Third-party services are not controlled by TruNutra and may be governed by separate terms and privacy policies. To the fullest extent permitted by law, we are not responsible for third-party content, products, security, availability, representations, policies, practices, or performance.
A link to or integration with a third-party service does not necessarily constitute endorsement of that third party.
17. Relationship with Shopify
The TruNutra online store is hosted and supported by Shopify, which provides the ecommerce technology that allows us to offer products and process transactions.
Purchases made through the TruNutra store are transactions between you and TruNutra. Shopify is not the seller of TruNutra products and is not responsible for the fulfillment, quality, safety, labeling, use, return, or refund of products purchased from TruNutra.
Your use of Shopify-supported features may also be subject to Shopify’s applicable terms and privacy practices.
18. Errors, Inaccuracies, and Omissions
Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, ingredients, directions, warnings, pricing, promotions, discounts, shipping charges, delivery estimates, or availability.
We may correct errors, update information, or cancel affected orders when information is inaccurate, including after an order has been submitted, subject to applicable law.
We are not obligated to update or clarify information except where required by law.
19. Availability and Security
We work to keep the Services available and secure, but we do not guarantee that they will operate without interruption, delay, error, data loss, harmful components, or unauthorized access.
We may suspend, restrict, or disable any part of the Services for maintenance, security, fraud prevention, legal compliance, system updates, operational needs, or other legitimate reasons.
You are responsible for maintaining appropriate hardware, software, internet access, and security protections when using the Services.
20. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUNUTRA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR NEEDS, OR THAT USING A PRODUCT WILL PRODUCE A PARTICULAR RESULT.
CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF PARTICULAR WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUNUTRA AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, SUPPLIERS, PARTNERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO:
- Your access to or use of, or inability to access or use, the Services;
- Your purchase, possession, use, misuse, storage, or disposal of a product;
- Your reliance on product information, educational content, customer reviews, or other materials;
- Third-party conduct, content, platforms, or services;
- Unauthorized access to or alteration of your information; or
- These Terms.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUNUTRA’S TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO A PRODUCT, THE SERVICES, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- The amount you paid to TruNutra for the specific product or transaction giving rise to the claim during the six months before the claim arose; or
- One hundred U.S. dollars (US $100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability imposed by applicable product-liability or consumer-protection law.
22. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TruNutra and its affiliates, owners, officers, directors, employees, contractors, service providers, licensors, suppliers, partners, and representatives from claims, damages, judgments, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your unlawful or unauthorized use of the Services or products;
- Your User Content;
- Your breach of these Terms;
- Your violation of applicable law; or
- Your violation of another person’s rights.
This provision does not require you to indemnify any party for conduct for which indemnification cannot lawfully be required.
23. Suspension and Termination
We may suspend, restrict, or terminate your access to the Services, cancel an account, or decline or cancel orders if we reasonably believe that you:
- Violated these Terms or another applicable policy;
- Failed to pay an amount properly owed;
- Created legal, security, safety, fraud, or operational risk;
- Used the Services in an unlawful, abusive, harmful, or disruptive manner; or
- Engaged in conduct that may harm TruNutra, another customer, or a third party.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, governing law, and interpretation.
24. Events Outside Our Control
TruNutra will not be responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, transportation interruptions, carrier delays, supply shortages, manufacturing disruptions, utility failures, internet outages, cyberattacks, government actions, or changes in law.
25. Governing Law
These Terms and any dispute arising from or related to the Services or these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless applicable law requires otherwise.
26. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified only to the extent necessary to make it enforceable. The remaining provisions will remain in full force and effect.
27. No Waiver
A failure or delay by TruNutra in exercising a right or enforcing a provision of these Terms does not waive that right or provision. A waiver is effective only if made in writing by an authorized representative of TruNutra.
28. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. TruNutra may assign or transfer these Terms in connection with a merger, acquisition, financing, sale of assets, corporate reorganization, change of control, or transfer of the Services, subject to applicable law.
29. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, Mobile Terms of Service, and any offer-specific terms presented at checkout, constitute the entire agreement between you and TruNutra concerning the Services and supersede prior or contemporaneous communications concerning their subject matter.
If offer-specific written terms conflict with these Terms, the offer-specific terms control solely with respect to that offer. Rights provided by applicable law remain unaffected.
30. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.
When required by law, we will provide additional notice of material changes. Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms.
